PRIVACY POLICY (GDPR)

§ 1
Who is the Controller of your personal data?
In accordance with Article 13 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data, on the free movement of such data and on the repealof the Directive 95/46/EC (General Data Protection Regulation) referred to as GDPR, as well as the Act of 26 May 2018 on the protection of personal data (Journal of Laws of 2018, item 1000), Fitness Club 24 Sp. z o.o. informs you that:
– the Controller of your personal data is Fitness Club 24 Sp. z o.o., Komorowicka 110, 43-300 Bielsko-Biała; KRS: 0000285747, NIP: 5472076763, REGON: 240734176, represented by PETER JANAS – President of the Board, entered in the Register of Entrepreneurs by the District Court in Bielsko-Biała, VIII Division, hereinafter referred to as ” FITNESS CLUB 24″.

§ 2
For what purposes and on what basis do we process your personal data?
In order to provide services in accordance with the activity profile, FITNESS CLUB 24 processes your personal data for various purposes, but always in accordance with the law. The following are the specified purposes of processing your personal data, together with the legal bases.
1) In order to provide a quote for products after submitting the form, we may process personal data such as:
– company name,
– contact person,
– e-mail,
– address,
– phone number.
The legal basis for such processing is Article 6(1)(b) of the GDPR, which allows us to process personal data if they are necessary to take steps to conclude a contract.
2) In order to survey customer satisfaction, improve and modify our products, we process personal data such as:
– name,
– IP address,
– e-mail.
The legal basis for such data processing is Article 6(1)(f) of the GDPR, which allows us to process personal data if by doing so the Controller pursues their legitimate interest (in this case, FITNESS CLUB 24’s interest is to learn about customers’ opinions on products and the level of service in order to adapt them to the needs and expectations of those concerned).
3) In order to create records and registers related to the GDPR including, for example, a register of customers who have objected in accordance with the GDPR, we process personal data such as:
– name,
– email.
The GDPR regulations impose certain documentation obligations on us to demonstrate compliance and accountability. For example, if you object to the processing of your personal data for marketing purposes, we need to know to whom not to apply direct marketing.
The legal basis for such processing is Article 6(1)(c) of the GDPR, which allows us to process personal data if such processing is necessary for the Controller to comply with their obligations under the law (provisions contained in the GDPR), and Article 6(1)(f) of the GDPR, which allows us to process personal data if by doing so the Controller pursues their legitimate interest (in this case, FITNESS CLUB 24’s interest is to know about individuals who are exercising their rights under the GDPR).
4) For analytical purposes, i.e. research and an analysis of activity on the website belonging to FITNESS CLUB 24, we processpersonal data such as:
– date and time of a visit,
– type of operating system,
– approximate location,
– type of Internet browser used to browse the site,
– time spent on the site,
– IP address.
The legal basis for such data processing is Article 6(1)(f) of the GDPR, which allows the processing of personal data if by doing so the Controller pursues their legitimate interest (in this case, the interest of FITNESS CLUB 24 is to learn about the customers’ activities on the website).
5) In order to use cookies on the website, we process textual information (cookies will be described in a separate section).
The legal basis for such processing is Article 6(1)(a) of the GDPR, which allows us to process personal data on the basis of voluntarily given consent (when you first access the website, a request for consent to the use of cookies appears).
6) In order to administer the website, we process personal data such as:
– IP address,
– server date and time,
– information about the Internet browser,
– information about the operating system – these data are saved automatically in the so-called server logs, every time you use the pages belonging to the Fitness Club 24.
It would not be possible to administer the website without using the server and without this automatic record.
The legal basis for such data processing is Article 6(1)(f) of the GDPR, which allows the processing of personal data if in this way the Controller pursues their legitimate interest (in this case, the interest of FITNESS CLUB 24 is the administration of the website).
§ 3
How long is your personal data processed?
Your personal data are processed in connection with:
– making a quote for products after submitting the completed form – until the service is provided,
– customer satisfaction survey, improvement and modification of our products – to create our internal reports, analyses and statistics,
– creating registers and records related to GDPR – until the Controller fulfils their obligations under the law,
– analytical purposes – for the period of existence of the legally justified interest pursued by FITNESS CLUB 24, however not longer than the period of limitations for claims against the data subject,
– use of cookies on the website – until the data subject withdraws consent,
– website administration – data shall be recorded automatically in the so-called server logs each time the website is used.
§ 4
Who has access to your personal data?
We may disclose your personal data to the following entities:
– employees – in order to provide services,
– IT, logistic or support entities – for the purpose of providing services.

What rights do you have in relation to the processing of your personal data?
In connection with the processing of your personal data, you have the right to:
– access the content of your data and receive a copy of it (Art. 15 GDPR),
– rectify/correct your data (Art. 16 GDPR),
– erase your data (Art. 17 GDPR),
– restrict processing (Art. 18 GDPR),
– transfer your data (Art. 20 GDPR),
– object to the processing of your data (Art. 21 GDPR),
– withdraw consent to data processing (Art. 7(3) GDPR),
– lodge a complaint to the supervisory authority: Personal Data Protection Office, Stawki 2, 00-193 Warsaw (Art. 77 GDPR).
§ 6
Other.
Providing personal data is voluntary.
The obtained personal data shall not be transferred outside the European Economic Area or to an international organisation.

§ 7
Cookies
FITNESS CLUB 24 on its website, similarly as other entities, uses the so-called cookies, i.e. short text information stored on your computer, phone, tablet or other device. They can be read by our system and by systems belonging to other entities whose services we use (e.g. Facebook, Google).

Cookie policy

Cookies are small text files which are automatically stored by the web browser on your computer, phone, smartphone or other device when you visit a website. Cookies are necessary as they make the website easier to use and more user-friendly. Cookies are not harmful to your computer. The entity placing cookies on your terminal device is Fitness Club 24 Sp. z o.o. with its registered seat in Bielsko-Biała, Komorowicka 110. Fitness Club 24 Sp. z o.o. does not collect any information automatically, with the exception of information contained in cookies. Cookies allow the information contained in them to be read only by the server that created them, in this case the Fitness Club 24 Sp. z o.o. website.
Cookies placed by Fitness Club 24 Sp. z o.o. contain the name of the website from which they come, the time of storage on the terminal device, and a unique number.
Purposes for which cookies are used:
– adjusting the content of the website to the user’s preferences and optimising the use of its resources – in particular, these files allow for recognition of the website user’s device and appropriate display of the content adapted to their individual needs,
– creation of visit statistics (Google Analytics), which help to determine from which devices, when and where the visit occurred, andto thoroughly analysethe website traffic,
– providing information on the user’s IP number which is used for identification purposes until the user creates an account and voluntarily provides other data,
– providing users with personalised products more suited to their interests and search history.
The end user may consent to the storage of cookies from the Fitness Club 24 Sp. z o.o. website on their end device using the settings of the web browser installed on their device, e.g.: laptop, tablet, smartphone. In many cases, the software used to browse the website (Internet browser) allows the storage of cookies on the device used by the userby default. Users may, at any time, change the settings concerning cookies on their device or completely block the installation of files from our server. After applying such settings, it is possible that the user will not be able to access some of the content of our website, the use of our website may be less efficient, or the user may not be able to use some services. If the user prefers to restrict, block or delete cookies from the website, this can be done in the browser settings.
